I have been refused funding from NDIS. What do I do?
You will need to lodge a decision review within 3 months from the decision and provide NDIS all necessary information they may require. This can be done on your own or with the help of a solicitor.
What is a Decision Review?
A decision review is an internal review into the decision made by NDIS. This ensures that applicants have a chance to request a second opinion. You have the right to seek a review if you believe that you should be eligible for NDIS funding and have been denied, and/or if you disagree with any changes made to your plan. An internal review will be conducted and you should receive an outcome within 60 days.
What if my internal review has been rejected?
If you do not agree with the outcome from your decision review an external review can be conducted through the Administrative Review Tribunal. This must be completed within 28 days from the internal review decision.
Who is the Administrative Review Tribunal?
The Administrative Review Tribunal reviews decisions made by Australian Government agencies, departments and ministers. They are a fair, accessible and independent organisation who ensure that the decisions made by NDIS are legally correct and fair.
What do I do if I have missed my due dates for a Review?

Can I use my funding to pay for a Lawyer?
No, you cannot use your NDIS funding for a solicitor to represent you at the tribunal. However, you can use you NDIS funding for disability-related support that may be required during the hearing. For example, you may need communication support to help you attend the hearing.
How do I submit an Internal Review?
You will need to complete the Request for Decision Review document.
How do I submit an External Reivew?
Apply online through the Australian Review Tribunal website, however, there are strict time limits.
